Objetivo: realizar una puesta de información actualizada sobre la normativa de protección de datos en situaciones específicas, como sucede en el hecho de que la salud de terceras personas se ve comprometida por respetarla. Marco conceptual: el secreto profesional posee una condición moral y otra jurídica, siendo un deber guardarlo para evitar resultados nocivos para el paciente si este se desvela y una obligación establecida por la legislación. Actualmente, hay una tendencia que va en aumento, tanto desde un punto de vista ético como jurídico, de sopesar si es conveniente quebrantar el secreto profesional para proteger otros intereses importantes como puede ser la integridad física de terceras personas. Conclusiones: se deben proteger los derechos e intereses de las personas infectadas por enfermedades transmisibles y de las personas sanas, intentando siempre garantizar su bienestar.
Objective: it is aimed at showing updated information on data privacy regulation regards breach of professional secrecy when it compromises health of third parties. Theoretical framework: professional secrecy possesses moral and legal conditions. If unveiled might have a negative effect on both patient and professional. Morally on the former and legally on the latter, as it is bound by law. It is under this premise that a current tendency has arisen. From both ethical and legal dimensions, it considers whether it is advisable to breach professional secrecy to protect more important issues, such as physical integrity of third parties. Conclusion: rights and interests of people infected by transmissible diseases – as well of healthy ones – must always be protected by ensuring their welfare.
